Heard Shri Raj Narayan, learned counsel for the applicants.
This application has been filed for transferring the Appeal No. 860 of 2019 (Gafaru Nisha and others Vs. Jaitun Nisha) filed under Section 11 of the U.P. Consolidation of Holdings Act before the Settlement Officer Consolidation, Basti to any other court of competent jurisdiction in other district like Gorakhpur, Siddharth Nagar, Faizabad etc.
The sole allegation against the Settlement Officer Consolidation, Basti is that the Kanungo of Tehsil Basti Sadar, namely, Riyazat Ali s/o Salahaat Ali is the relative of the respondent no. 2 and he comes to the court of the respondent no. 1 and has good relations with the Settlement Officer Consolidation and he is openly saying that the applicants will be defeated in the appeal.
It is clear from the averment made in paragraph no. 6 of the affidavit filed in support of the application that no allegation has been made against the respondent no. 1. Moreover, the allegation itself is vague and is not substantiated in this affidavit.
This application is, accordingly, dismissed.
