JUDGMENT / ORDER

HON’BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.66 of 2010
Date: April 16, 2014
Between:
Gadde Babu Rao.
… Petitioner And
1. Government of Andhra Pradesh, Higher Education (IE.1) Department, Hyderabad, rep. by Principal Secretary to Government & 4 others.
… Respondents * * * HON’BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.66 of 2010
O R D E R:
Heard learned counsel for the petitioner.
This writ petition was filed challenging the action of the first respondent in issuing G.O.Rt.No.824 Higher Education (IE.I) Department dated 26.08.2008, according administrative sanction for construction of attached hostel building in the premises of Government Junior College, Cheepurupalli, Vizianagaram District.
2. The petitioner also filed another writ petition, W.P.No.3284 of 2009, apprehending change of name of the college from G.V.R. Government Junior College, Cheepurupalli, to Government Junior College, Cheepurupalli. On the averments made in the counter-
affidavit that no orders have been passed changing the name of the college from G.V.R. Government Junior College, Cheepurupalli, to Government Junior College, Cheepurupalli, Vizianagaram District, the said writ petition was closed.
3. The present writ petition is filed on the apprehension that since the proposed hostel building is about 10 feet away from the existing college building and the college being a co-educational college where number of girl students attend the classes, it would be inconvenient to the girl students to attend the college when the hostel building is close to the college. The impugned Government Order does not speak about the exact location of the hostel within the college, but it merely spells out the administrative sanction for construction of attached hostel building for B.Cs. in five Government Junior Colleges in various districts, including one in Government Junior College, Cheepurupalli, Vizianagaram District.
4. The learned counsel for the petitioner fairly submits that he is not against the construction of a hostel building, but his apprehension is that if the hostel building is located close to the college, it will be embarrassing to the girl students attending the classes, as they may be subjected to harassment and unruly behaviour by some mischievous students. However, the location of hostel building is a matter within the domain of concerned authorities and this Court cannot issue any direction to the authorities to locate the hostel building in a particular place, since the petitioner is not opposing construction of the hostel building. As such, it cannot be said that issuance of administrative sanction for construction of attached hostel building is bad.
5. In the circumstances, the authorities are directed to take into consideration the apprehensions expressed by the petitioner with regard to location of the hostel building in order to not to cause any embarrassment to girl students attending the college and this Court hopes that the authorities would take necessary steps in that matter.
6. In that view of the matter, no further adjudication is necessary in the present writ petition also and accordingly the same is disposed of subject to the above observations. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
