Gaddam Rajeshwar Rao … Petitioner and The Singereni Collieries Company Limited and others … Respondents THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.22577 OF 2012 O R D E R The petitioner, a Mining Sardar in Singareni Collieries Company Limited (SCCL), was terminated from service under the impugned proceedings dated 06.07.2012. He challenged the said proceedings by way of this writ petition and sought a consequential direction to the SCCL to consider his case for appointment to any other suitable job on the surface. By interim order dated 26.09.2013, this Court directed the SCCL to engage the petitioner in a suitable equivalent post duly protecting his pay as Senior Mining Sardar.
Though a vacate stay in WVMP No.3505 of 2013 has been moved by the SCCL and its officers, it is fairly conceded by the learned standing counsel appearing for the SCCL that pursuant to the interim order, the case of the petitioner was considered and he was accommodated in the post of Senior Mining Sardar on the surface.
In that view of the matter, the cause in this writ petition does not survive for adjudication on merits. However, it is left open to the petitioner to pursue such remedies as are available to him in law for the benefits denied to him during the period that he was kept out of service.
Subject to the above liberty, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
