(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The basis of the present petition is the order dated 27.07.2011 passed by the Division Bench of this Court in LPA No.3094/10 whereby the direction was to reinstate the applicant within period of two months from the date of the order.
Upon hearing Mr.Thacker for the applicant and Mr.Sojitra for the respondents, it appears that it is an undisputed position that the applicant has been reinstated in service on 14.05.2012 and therefore, the grievance for reinstatement would not survive. However, the direction was to operate from 27.09.2011 whereas the actual reinstatement has taken place on 14.05.2012. Therefore, the respondent would be required to pay the salary to the applicant for the aforesaid period.
We would have further considered the matter. However, Mr.Sojitra, learned counsel under the instruction of his client states that the salary for the aforesaid period shall be paid by the respondent within a period of two months from today to the applicant. Hence, we direct the respondents to comply with the declaration made before this Court.
In view of the above, the grievance of the petitioner would no more survive. Disposed of accordingly. Notice discharged. Liberty to apply in case of difficulty.
