(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Pursuant to the earlier order passed by this Court, Mr.Ashok Solanki, Chairman and Mr.Girish Patel, Secretary are present. The learned Counsel appearing for them, under their instructions, states that they have no objection if any engineer, who may be deputed by the Municipal Corporation examines and suggests repairing for compliance of the order of the learned Nominee and they shall bear the expenses for the remuneration to be paid to that Engineer and also shall bear the expenses for repairing work to be undertaken and he states that towards remuneration of the Engineer, his client shall deposit the amount of Rs.10,000/- within one week.
The directions, which have not been complied with and for which the grievance is raised in the present petition are directions No.2 and 3 of the order dated 31.3.2011 passed by the learned Nominee, the English translation of which reads as under:-
"(2) The defendant No.1 Society is directed to find out the leakage of water pipeline and drainage through the Engineer and get the same repaired.
(3) The defendant No.1 shall bear the expenses of the engineer and plaintiff and defendant No.2 shall bear expenses on 50% basis for repairing of water pipeline and drainage pipeline."
Since the Corporation will have to depute any engineer for such purpose, the Commissioner, Ahmedabad Municipal Corporation is directed to assign the work to any engineer working under him preferably well-versed with the area, within one week. Such Officer shall examine the premises and shall suggest the repairing work to be undertaken for such purpose and he shall submit the report on or before 17.7.2012. The necessary arrangement for getting the repair work shall be worked out by engaging the machinery by the Society. S. O. to 17.7.2012. Direct service is permitted.
