This Writ Petition is filed for a mandamus to set-aside proceedings in Roc.K/2758/2014, dated 22-9-2014 whereby respondent No.2 has suspended the petitioner’s fair price shop authorisation.
This Court, by order dated 26-9-2014 has suspended the said order.
Inasmuch as the enquiry into the three charges levelled against the petitioner is pending, I refrain from expressing any opinion on the sustainability or otherwise of the charges. As the impugned order has been kept under suspension, it is appropriate that the petitioner is permitted to continue as the dealer till the enquiry is completed by respondent No.2 and a final order is passed.
Accordingly, respondent No.2 is directed to complete the enquiry wherein he shall give an opportunity of hearing to the petitioner and pass a speaking order after considering the petitioner’s defence in an objective manner. Till this process is completed, the petitioner shall be continued as the fair price shop dealer.
The Writ Petition is accordingly disposed of.
As a sequel to the disposal of the Writ Petition, WPMP No.36981 of 2014 is disposed of as infructuous.
