ORDER:
This company petition is filed for an order to wind up the respondent for non-payment of debt due to the petitioner.
After arguing the case, Mr. M. Janardhan Rao, learned counsel for the petitioner, requested for permission to withdraw the company petition, with liberty to his client to issue a proper statutory notice under Section 434(1)(a) of the Companies Act, 1956, and file a fresh petition for winding up in the event the respondent does not settle the dispute after such notice.
The company petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
