Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents.
The petitioner seeks to challenge the notice issued by respondent No.3 proposing to conduct survey of land in R.S.No.113, situated at Saripalle Village, Koyyalagudem Mandal, West Godavari District, on 26.07.2014. The petitioner claims to be the owner of land admeasuring Ac.1- 50 cents in R.S.No. 108/2A and 113 of the same village.
The aforesaid notice is questioned primarily on the ground that under the garb of conducting survey, the petitioner would be dispossessed and her land would be disturbed as there is already a pressure on her to settle the land in favour of respondent No.7 on account of the pressure exercised by respondents 4 and 5. The petitioner, therefore, apprehends that the survey operation is intended to disturb her possession.
In my view, the apprehension of the petitioner is clearly misconceived, as the impugned notice only intends to conduct survey, and since the petitioner is an adjacent cultivator, the notice has been issued to her and similar notices have also been issued to other neighbouring cultivators and pattadars. The survey operation, if not conducted already, is required to be conducted by the third respondent-Tahsildar in accordance with the Andhra Pradesh Surveys and Boundaries Act and Rules thereunder and the instructions of the Department and complete the survey operation without affecting any pattadars’ possession over their respective lands.
The Writ Petition is accordingly disposed of with a direction as above. Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
