ORDER:
This writ petition is filed for the following substantive relief:
“…to issue Writ of Mandamus to call for the records in Proc.No.55/2014/A2, dated 19.11.2014 from Respondent No.2, by declaring the action of Respondent No.3 for not to entertain the application for release of the seized vehicle Tata Hitachi Excavating Machine to the Petitioner are illegal, arbitrary and contrary to the law, while directing Respondent No.2 to release the Vehicle TATA Hitachi Excavator Ex-200 of 2005 model Serial Number 2001-5664 to the Petitioner for interim custody in P.O.R.No.013902/01/2013, Singoor, Range Manjeera, Medak District.”
After arguing the case, Sri Thumu Chandra Shekar, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to move the jurisdictional Magistrate for release of the seized equipment.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the writ petition, W.P.M.P.No.45892 of 2014 shall stand disposed of as infructuous.
