THE HON’BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.22 of 2014 ORDER:
The petitioners, who are accused Nos.3 and 4 in C.C.No.509 of 2008 on the file of the Judicial Magistrate of First Class, Jadcherla, Mahabubnagar District, filed this Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of all further proceedings in the above C.C. A charge sheet came to be filed against the petitioners and three others for the offences punishable under sections 468, 420, 419 and 109 read with 34 IPC.
When the matter is taken up for hearing, the learned counsel for the petitioners seeks permission to withdraw the petition, with a liberty to the petitioners to file an application for discharge, in case the charges have not already framed in C.C.No. 509 of 2008 on the file of the Judicial Magistrate of First Class, Jadcherla.
Permission as sought for is accorded.
Accordingly, the Criminal Petition is dismissed as withdrawn with a liberty to file an application for discharge before the Court concerned in case the charges are not already framed and the learned Magistrate shall dispose of the same as expeditiously as possible in accordance with law. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand dismissed.
