WRIT PETITION No.31649 of 2014
ORDER:
This writ petition is filed for a mandamus to set aside proceedings vide Ref.D/853/2014, dated 15.10.2014 of respondent No.2 whereby he has suspended the petitioner’s fair price shop authorization.
On finding that the alleged variations have been well within the permissible limit, this Court while suspending the impugned proceedings has directed appearance of respondent No.2.
Today, respondent No.2 is personally present.
At the hearing, learned Government Pleader for Civil Supplies (Andhra Pradesh) has submitted that respondent No.2 has passed order on 21.12.2014 restoring the petitioner’s authorizations. Respondent No.2 has submitted to the Court that further proceedings against the petitioner have been dropped as the alleged variations are trivial in nature. Respondent No.2 has further submitted that he will not resort to the action of suspension of fair price shop authorization on trivial grounds, in future.
In view of remedial steps taken by respondent No.2, the Writ Petition stands disposed of with the warning to respondent No.2 not to repeat such conduct in future.
As a sequel to disposal of main petition, interim order, dated 21.10.2014 is vacated and WPMP.No.39563 of 2014 and WVMP.No.3435 of 2014 are disposed of.
