Respondent These Writ Petitions are filed under Articles 226 and 227 of the Constitution of India, praying to quash the order passed by the learned 6th Addl. Prl. Family Judge, Family Court at Bangalore in M.C.No.774/2011 on I.A.No.1/19 and 2/19 dated 08.04.2019 marked as Annexure – F and etc., These Writ Petitions coming on for Preliminary Hearing in 'B' Group, this day, the court made the following:-
ORDER Sri.Karthik.P.M, learned counsel for Sri.Rakshit K.N, learned counsel for the petitioner.
Smt.Rama R. Iyer, learned counsel for the respondent.
2. The petitions are admitted for hearing.
With the consent of learned counsel for the parties, the same are heard finally.
3. In these petitions under Article 227 of the Constitution of India, the petitioner inter alia seeks for a writ of certiorari for quashment of the order dated 08.04.2019 in M.C.No.774/2011 passed by the VI Additional Principal Judge, Family Court, Bengaluru.
4. When the matters were taken up today, learned counsel for the petitioner submitted that the petitioner shall produce two witnesses on such date as may be fixed by this Court and the respondent be directed to cross-examine them on the aforesaid date.
5. Learned counsel for respondent submitted that counsel appearing for the respondent before the trial Court shall cross examine petitioner’s witnesses on the date fixed by this Court and the writ petitions be disposed of with a direction to the Family Court to conclude the proceedings within an outer limit of one month from today.
6. In view of the submissions made and in the facts of the case, it is directed that the petitioner shall produce his two witnesses on 02.08.2019. On the aforesaid date, learned counsel for respondent shall cross-examine the witnesses of the petitioner and thereafter, the Family Court shall proceed to hear the arguments in the matter and shall conclude the proceedings within an outer limit of one month from today.
In the result, the impugned order dated 08.04.2019 is quashed. Accordingly, the writ petitions are disposed of.
