Heard the learned counsel for the petitioners. None appears for the respondents.
2. The writ petition was filed by the parents stating that they have three sons and one daughter. Eldest son was married and there were matrimonial disputes between them. The youngest son was working as Archaka along with the 2nd petitioner. On 17.12.2007, the petitioners along with their youngest son went to the office of CPM Party, Balaji Nagar, Nellore for negotiations in connection with the dispute between the eldest son and his wife. As there was no settlement, they came back to their house at Varakavipudi village. On 18.12.2007, their youngest son, G.V.Kiran Kumar left the house stating that he is going to Nellore town and thereafter, he did not return to the house. They searched at some places and lodged a complaint on 05.01.2008, suspecting the involvement of the family members of their daughter-in-law. They also made complaint to the Collector and District Magistrate on 12.01.2008 apart from making representation to the local Minister on 25.01.2008. Challenging the inaction of the respondents pursuant to the complaint made on 05.01.2008, the present writ petition was filed.
3. The 3rd respondent filed counter-affidavit admitting the fact that the petitioners lodged a complaint on 05.01.2008 stating that their son Gudali Venakta Kiran Kumar was missing since 18.12.2007. Basing on the said complaint, a case in Cr.No.8 of 2008 under the head of ‘Man Missing’ was registered on 21.05.2008 and investigation was taken up. During the course of investigation, 10 witnesses were examined and their statements were recorded. Thorough enquiries were made about the missing person, but no clues had been found. On 29.01.2008, the 3rd respondent flashed the message to all the police stations in Nellore district. The petitioners sent a message to this Court and the same was taken up as WP No.5466 of 2008 and was disposed of on 31.03.2008 observing that since crime was registered and investigation was in progress and some witnesses have been examined, the police were directed to complete the investigation and file final report as expeditiously as possible, preferably within one month from that date. After completion of the investigation, the case was referred as ‘undetectable’ on 09.12.2010.

It is clear from the above facts that the son of the petitioners was missing from 18.12.2007 and a complaint was lodged on 05.01.2008 by the petitioners and the respondents took four months time for registering the same as Cr.No.8 of 2008. However, the investigation was completed and a final report was submitted before the competent Court. In the circumstances, the petitioners are given liberty to take appropriate steps before the competent Court, which is seized the matter.
5. With the above observation, the writ petition is disposed of. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
