SPP) This Criminal Petition is filed under Section 482 of Cr.P.C., praying to quash the proceedings in C.C.No.22796/2012 filed in Crime No.462/2011, pending on the file of the Hon’ble 10th ACMM Court, Mayo Hall at Bangalore.
This Criminal Petition coming on for Admission, this day, the Court made the following:-
ORDER Sri Kiran N Murthy, learned counsel for petitioners.
Mr. Vijayakumar Majage, learned Additional State Public Prosecutor for respondents.
Petition is admitted for hearing with the consent of learned counsel for the parties and the same is heard finally.
2. In this petition under Section 482 of Code of Criminal Procedure, 1973, the petitioners seek quashment of the proceedings in C.C.No.22796/2012 pending before the X Additional Chief Metropolitan Magistrate, Mayo Hall, Bengaluru.
3. When the matter was taken up today, learned counsel for petitioners fairly submitted that charge sheet was filed against the petitioners on 03.12.2012 and the trial has already commenced. He, therefore submits that this petition be disposed of with a direction to the trial court to conclude the proceedings expeditiously in accordance with law and liberty be granted to the accused to file application seeking discharge before the trial court.
4. In view of the aforesaid submissions and the facts of the case, petition is disposed with a direction to the trial court to conclude the proceedings pending before it expeditiously within a period of four months from the date of receipt of a certified copy of the order.
5. It is needless to state, in case any application for discharge is filed on behalf of accused No.1, the same shall be dealt with in accordance with law by the trial court.
6. With the aforesaid direction, petition is disposed of.
