ORDER:
This writ petition is filed for a mandamus to set aside proceedings in Rc.J/1188/2014, dated 11.09.2014, of respondent No.2, whereby he has suspended the petitioner’s fair price shop authorisation.
In obedience to the notice issued by this Court, respondent No.2 is personally present. While admitting that he has committed serious mistake in suspending the petitioner’s authorisation despite the fact that the alleged variation is well within the permissible limits under Clause 24(1) of the A.P.State Public Distribution System (Control) Order, 2008 he has placed before this Court a copy of proceedings in Rc.J/1188/2014, dated 29.11.2014, whereby he has restored the petitioner’s authorisation. He has also orally submitted that he will drop all further proceedings against the petitioner based on the charges mentioned in the impugned order. He has further assured that he will not repeat his conduct in suspending the authorisations of the fair price shop dealers on frivolous charges, such as the ones which are mentioned in the impugned proceedings.
In view of the corrective steps taken by respondent No.2 and the remorse he has shown, the action proposed against him is dropped and the writ petition is disposed of as infructuous.
As a sequel to disposal of the writ petition, W.P.M.P.No.40912 of 2014 shall stand disposed of as infructuous.
