This writ petition is filed for a mandamus declaring the action of the 3rd respondent in issuing the proceedings in Rc.No.2425/14L, dated 19-07-2014 suspending authorisation of the petitioner's fair price shop and also show cause notice dated 19- 07-2014 as illegal and arbitrary and for a consequential direction to set aside the said proceedings.
2. The case of the petitioner is that he is running a Fair Price Shop No.14 of Muppalla village, Muppala Mandal since 2008 and has been distributing essential commodities to the cardholders without any deviation. While so, as the petitioner is not distributing essential commodities received for the month of July, 2014 to the cardholders, the authorisation of the petitioner's fair price shop is suspended by the 3rd respondent vide proceedings in Rc.No.2425/14L, dated 19-07-2014 and the petitioner was also issued a show cause notice dated 19-07-2014, pursuant to which the petitioner submitted his explanation on 06-08-2014, but no orders are passed till now. But, the authorisation of the petitioner is kept under suspension without any reason. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
4. It is stated that since the petitioner is unwell for four days, he could not supply the stocks and the petitioner submitted his explanation to the show cause notice, but no orders are passed thereon.
5. Having regard to the facts and circumstances of the case and in view of the fact that the petitioner has already submitted his explanation to the show cause notice dated 19-07-2014, the 3rd respondent is directed to consider the explanation of the petitioner dated 06-08-2014 and pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of two
(2) weeks from the date of receipt of a copy of the order. Till necessary orders are passed by the 3rd respondent, the petitioner shall be continued as a fair price shop dealer.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
