The petitioner complains of the inaction in spite of himself and his wife filing complaints on 29.10.2014 and 13.11.2014, respectively.
Learned Government Pleader for Home has received instructions, which show that on 12.11.2014 a complaint was received from respondent No.7, which is registered as Crime No.1031 of 2014 under Sections 354A, 506 and 509 IPC and investigation is taken up. So far as the petitioner’s complaint is concerned, it is found that the same is lodged due to non-payment of rent and bills by respondent No.6 and his wife - respondent No.7. It is evident that the petitioner and respondent Nos.6 and 7 are closely related and as the dispute between them appears to be civil in nature, no action was taken by the Police.
Learned counsel for the petitioner states apart from the complaint with regard to non-payment of rent etc., it was also stated in the complaint that respondent Nos.6 and 7 are harassing the wife of the petitioner mentally and physically and there is also an allegation that both of them have threatened his mother-in-law that they would kill her. Learned counsel, therefore, states that ignoring the claims regarding non-payment of rent, to the extent of threats given, the complaint deserves to be looked into by the official respondents.
The Writ Petition is, accordingly, disposed of directing respondent No.4 to look into the complaint of the petitioner, as aforesaid, and if any cognizable offence is made out, to take action in accordance with law. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
