The Civil Revision Petition is filed under Article 227 of the Constitution of India to set aside the docket order dated 11.10.2017 of the Hon'ble II Additional Family Court, Chennai in HMOP.No.3179 of 2016 and to dispose of all interim applications pending in the same.
For petitioner : Mr.R.Srinivas ORDER According to the learned counsel for the revision petitioner, the revision petitioner has filed an application before the II Additional Family Court, Chennai for interim maintenance. The said application has not been numbered. Therefore, the revision petitioner has already filed a Civil Revision Petition before this Court in CRP.No.679 of 2017 and by order dated 23.02.2017, this Court has directed the court below to number the application for interim maintenance and pass appropriate orders on merits and in accordance with law after affording an opportunity to both sides. Pursuant to that, the revision petitioner has filed the application and the same has been numbered. According to the learned counsel for the revision petitioner, pursuant to the said order passed by this Court, the Family court has numbered the application and the same was adjourned from time time without disposing of the said application within the time fixed by this Court. Therefore, the present Civil Revision Petition has been filed by the revision petitioner to dispose of the same.
2. On perusal of the records, it is found that the grievance of the revision petitioner is that the court below has not complied with the order passed by this Court. The petitioner has to work out his remedy for non compliance of the earlier order passed by this Court in CRP.No. 679 of 2017, without availing the same, filing a Civil Revision Petition cannot be entertained by this Court and the Civil Revision Petition is liable to be dismissed.
3. In view of the above, the Civil Revision Petition fails and accordingly, the same is dismissed. Consequently, the connected miscellaneous petition is closed. No costs.
