Heard the learned counsel appearing for the petitioner and the learned stand counsel appearing for the respondent.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the respondent in not considering the representation of the petitioner dated 23-06-2014 promoting the petitioner from the post of Assistant Engineer to the post of Deputy Executive Engineer as illegal, arbitrary and unconstitutional, consequently, to declare that the petitioner is eligible and entitled to be promoted as a Deputy Executive Engineer in the respondent’s corporation.
The petitioner who is an Assistant Engineer attended for the personal interview on 7-11-2013 for promotion as Deputy Executive Engineer and in the process of selection, the Board has approved the panel list for the panel year 2013-14. The petitioner having come to know that one of the candidates in the panel has been promoted recently and her case was not considered for promotion, she made a representation dated 23-6-
2014 to the respondent.
In the circumstances stated by the learned counsel appearing for the petitioner, the respondent is directed to dispose of the representation made by the petitioner on 23-6-2014 and consider her case for promotion on par with other candidates in the panel as per rules, within a period of six weeks from the date of receipt of copy of this order.
Accordingly, the writ petition is disposed of. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
