HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.11275 of 2014 ORDER:
The case of the petitioner is that she is the owner of land to an extent of Ac. 5.64 cents in Survey No.1073 of Hathibelagal Village, Halaharvi Mandal, Kurnool District. The petitioner claims to have been inherited the said property. However, the revenue authorities have wrongly entered the above survey number in the prohibited list. Surprised by this, the petitioner submitted representations for rectification of the revenue records. A report was called from the Tahsildar, Alur, by the Revenue Divisional Officer, Adoni, Kurnool District (3rd respondent), regarding the status of the property and after the report furnished by the Tahsildar, Alur, the Revenue Divisional Officer recommended to the District Collector, Kurnool (2nd respondent) to correct the revenue records showing the status of the property in Survey No.1073 as private patta land. The said recommendation was made by the Revenue Divisional Officer in his letter, dated 22.04.2013. The case of the petitioner is that even after one year, no orders are passed on the said recommendation and because of the delay in rectifying the revenue records, great prejudice is caused to the petitioner.

Having regard to the submissions made, the Writ Petition is disposed of directing the District Collector, Kurnool (2nd respondent) to consider the report of the Revenue Divisional Officer, Adoni, Kurnool District (3rd respondent), dated 22.04.2013, and take a decision and communicate the decision to the petitioner. Such a decision shall be taken within a period of three (3) weeks from the date of completion of the schedule of general elections. Such a decision shall also be communicated to the Sub-Registrar, Alur, Kurnool District (5th respondent). There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
