Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue writ of mandamus or any other appropriate writ of direction declaring the action of the 3rd respondent in trying to allot Fair Price Shop dealership-II in favour of the 4th respondent without disclosing the marks obtained in written test/interview of the petitioner is illegal, arbitrary and against the principles of natural justice and further consequential direction to the respondents 1 to 3 not to make any appointments/order in respect of Fair Price Shop Dealership-II of Bantaram Village, Vikarabad Division, R.R. District in favour of the 4th respondent or any third parties.
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri Ch. Janardhan Reddy, Advocate for the Petitioner and Sri Venkata Raghu Mannepalli, Advocate for Respondent No.4, the Court made the following ORDER:
This Writ Petition is filed challenging the action of the third respondent in trying to allot Fair Price Shop dealership in favour of the fourth respondent without disclosing the marks obtained in the written test/interview.
Though the Writ Petition was filed in the year 2009, till today no counter affidavit is filed. When the matter was taken up for hearing on 10.07.2014, learned Government Pleader submitted that authorization was issued in favour of the fourth respondent in February, 2009; and, he sought time to file the counter affidavit. When the matter was listed again on 24.07.2014, learned Government Pleader was absent. Even today also when the matter is called, learned Government Pleader is absent.
In the circumstances, the third respondent is directed to file the counter affidavit positively by 14.08.2014.
