1. Ms. Samrin Naaz, Advocate holding brief of Sri A.D. Saunders, learned counsel for petitioner, states that he has no instructions in the matter. No other counsel has appeared on behalf of petitioner though the case is called in revise.
2. By means of the present writ petition, petitioner has sought the following relief:
“(i) To issue writ, order or direction including a writ in the nature of certiorari quashing the order dated 31.07.2004.
(ii) To issue writ, order or direction including a writ in the nature of mandamus directing the District Inspector of Schools to pay the salary of the Principal, teachers and other employees of the Institution on the basis of salary bills submitted by the Principal of the College.
(iii) To issue writ, order or direction including a writ in the nature of mandamus directing the District Inspector of Schools to return all the documents, salary register and cheque books etc. to the Principal of the College, forthwith.”
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting relief, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits.
5. Dismissed. Interim order, if any, stands vacated.
