After hearing the learned counsel for the appellant, we dispose of this writ appeal.
2. The learned trial Judge has found that there is no illegality either in conducting the auction or in withholding the initial deposit of 15% along with the earnest money deposit. This fact cannot be substituted by the appellate Court. Hence, we do not want to interfere with the same. However, we direct the respondents to return the earnest money deposit made by the appellant along with the 15% bid amount, without interest, within a period of one month from the date of communication of this order.
3. The writ appeal stands disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
