This writ petition is filed for a mandamus declaring the action of the 2nd respondent in not disposing the application of the petitioners for conversion of lands in an extent of Ac.4.20 cents in Sy.Nos.604/2 and 603/2 in Rudrapaka village, Nandivada Mandal, Krishna District into fish tanks as illegal and arbitrary and for a consequential direction to direct the 2nd respondent to process the application of the petitioners.
2. The case of the petitioner is that the petitioners are owners and possessors of an extent of Ac.4.20 cents in Survey Nos.604/2 (Ac.2.07 cents) and 603/2 (Ac.2.20 cents) in Rudrapaka village, Nandivada Mandal, Krishna District. It is stated that as their lands are low lying areas and are not ideal for paddy cultivation due to frequent inundation of the lands, they made an application on 16- 06-2014 to the 2nd respondent to grant permission for digging and conducting aquaculture operation, as per G.O.Ms.No.7, dated 16- 03-2013, which is pending consideration. But, no orders are passed thereon. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Fisheries.
4. Since it is stated that the application of the petitioners dated 16-06-2014 is pending consideration with the respondents, I deem it appropriate to direct the concerned authority to consider and dispose of the application of the petitioners in accordance with G.O.Ms.No.7, dated 16-03-2013, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of the order.
5. With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
