THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.22281 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the respondents in issuing impugned orders vide proceedings No.D.12/470/SA/2012 terminating the services of petitioner and directing recovery of Rs.12,24,823/- without appreciating the explanation and evidence submitted by the petitioner in proper perspective as illegal, arbitrary and in violation of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to reinstate the petitioner into service as Field Assistant.
The petitioner was appointed as Field Assistant of Dokuru village, Devarakonda Mandal, Mahabubnagar District in the year 2006. The second respondent issued a show cause notice dated 10-4-2013 to the petitioner alleging misappropriation of funds. The petitioner submitted her explanation on 30-4-2013, but according to the petitioner, the second respondent without considering her explanation, removed her from service. Thereafter, the petitioner preferred an appeal to the third respondent against the orders of the second respondent on 3-8- 2013. She submits that even though the appeal was filed one year ago, the appellate authority is not taking any steps to dispose of the appeal.
In the circumstances stated by the learned counsel appearing for the petitioner, the third respondent is directed to dispose of the appeal filed by the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
