HON’BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.19052 of 2014 Date: 10-07-2014 Between:
G. Ponnakesava Rao and another .. Petitioners AND The State of A.P., represented by Fisheries Department, Secretariat, Hyderabad and 6 others .. Respondents HON’BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.19052 of 2014 ORDER:
This writ petition is filed for a mandamus declaring the action of the respondents 2 to 7 in not granting Provisional and Final Registration Certificate to the petitioners for setting up fish tank as per G.O.Ms.No.7, dated 16-03-2013 in respect of land admeasuring Ac.73.83 cents in R.S.No.332/P, situated at Tummalapally village, Nandiwada Mandal, Krishna District as illegal and arbitrary and for a consequential direction to direct the respondents 2 to 7 to issue provisional and final registration certificate to the petitioners.
2. The grievance of the petitioner is that the petitioners 1 and 2 are absolute owners and possessors of land admeasuring Ac.73.83 cents in R.S.No.323 situated at Tummalapally village, Nandiwada Mandal, Krishna District and when they intended to convert their lands into fish tanks in view of their lands being laid in low area and are not fit for doing agricultural activities, they approached respondents 2 to 7 and applied for registration of new Fresh Water Aqua Culture Farm on 05-01-2014 after paying an amount of Rs.15,000/- by way of Demand Draft on 26-12-2013, as per G.O.Ms.No.7, dated 16-03-2013, but no orders are passed thereon. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Fisheries.
4. Since it is stated that the application of the petitioners is pending from 05-01-2014 with the respondents, I deem it appropriate to direct the respondents to consider the application of the petitioners dated 05-01-2014 and pass appropriate orders thereon in accordance with G.O.Ms.No.7, dated 16-03-2013, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of the order.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
