This Criminal Original Petition has been filed to set aside the Adjudication Order dated 12.05.2017 in C.C.No.5804 of 2006 on the file of Fast Track Court No.III, Metropolitan Magistrate, Saidapet, Chennai and to direct the learned Magistrate to permit further Cross Examination of P.W.1.

This Court, by Order dated 13.04.2017, in Crl.O.P.No.5554 of 2017 permitted the petitioner to cross examine P.W.1 on 26.04.2017 and the cross examination should be completed on the same day itself. Accordingly, cross examination was conducted and for want of time, the learned Judicial R.MAHADEVAN, J., sr Magistrate adjourned the case to 04.05.2017; once again, it was adjourned to 08.05.2017 and finally adjourned to 12.05.2017. On 12.05.2017, when the petitioner was ready for cross examination, it was denied by the learned Magistrate for the reason that this Court directed the petitioner to complete the cross examination on the same day itself i.e., 26.04.2017, which approach of the Magistrate, cannot be countenanced. Under such circumstances, the petitioner is permitted to conduct the cross examination of P.W.1 on 19.06.2017, on which date, the cross examination shall be completed. It is made clear that no further adjournment be permitted. With the above direction, the criminal original petition is disposed of. Consequently, connected Crl.M.P is closed.
