COMMON ORDER:
These three Writ Petitions have been filed feeling aggrieved by separate orders passed by respondent No.2 suspending the petitioners’ fair price shop authorizations pending enquiry.
In connection with certain other suspension orders passed by the incumbent of respondent No.2, this Court has summoned him to the Court and made him realise that while imposing penalties on the fair price shop dealers, he shall make an objective and rational approach without being guided by extraneous reasons. Respondent No.2 has undertaken that in future, he will act in a responsible manner while dealing with the allegations made against the fair price shop dealers. This Court, therefore, hopes that respondent No.2 will make an objective approach while holding enquiry and passing a final order.
As the impugned orders of suspension were passed more than two months back, instead of interfering with these orders, this Court feels that interests of justice would be met if respondent No.2 is directed to complete the enquiry and pass a final order by making an objective and rational approach.
Accordingly, the Writ Petitions are disposed of with the direction to respondent No.2 to hold a detailed enquiry, wherein he shall give the petitioners an opportunity of being heard, and pass speaking orders after a thorough verification of the records and consideration of the explanations of the petitioners without being guided by any extraneous reasons.
As a sequel, WPMP.Nos.45158, 45205 and 45206 of 2014 are disposed of as infructuous.
