Heard Ms. Roshni Shukla, learned counsel for the petitioner; Shri Amrish Sahai, Advocate for respondent no.1 and Shri Rajesh Kumar Vidyarthi, Advocate holding brief of Shri Sachindra Upadhyay, learned counsel for the respondent no.2.
The petitioner is before this Court with request to issue direction to the respondent authorities to ensure payment of his EPF amount in accordance with law.
Learned counsel for the petitioner states that after holding a departmental enquiry, the petitioner was compulsorily retired as Officer Scale-I of the Allahabad U.P. Gramin Bank on 27.11.2017 but his entire retiral benefits have not been paid to him till date. So far as the grievance of the petitioner is concerned, he has already filed a representation dated 20.3.2020 before the respondents for redressal of his grievance, which is still pending. He has confined his prayer only to the relief that his representation dated 20.3.2020 may be considered by the appropriate authority.
Learned counsel for the respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent/Commissioner, Employees Provident Fund, Lucknow to decide the petitioner's representation in accordance with law within a period of two months from the date of production of a certified copy of this order before him.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
