This Transfer CMP is filed to withdraw OS.No. 85 of 2014 from the file of First Junior Civil Judge, Secunderabad and transfer the same to Additional Rent Controller, Secunderabad to try along with RC.No. 25 of 2014.
2. As seen from the affidavit of petitioner, the petitioner herein filed suit for injunction restraining the respondent from interfering with possession till evicted under due process of law. It appears that respondent filed Rent Control Case seeking eviction of the petitioner. The comprehensive matter is the Rent Control Case. There is no necessity of joint trial, as the issue involved in the suit is very simple whereas the point involved in Rent Control Case is comprehensive one.
3. Considering the reasons stated in the affidavit, I am of the view that there are absolutely no grounds for transfer, as both matters have to be tried independently; one is by civil court and the other is by Rent Controller.
4. Considering the same, this Transfer CMP is dismissed at the admission stage.
5. As a sequel, miscellaneous petitions if any, pending in this Transfer CMP shall stands closed.
