JUDGMENT / ORDER

The petitioners, alleging that they have been falsely implicated by the respondent for the alleged offences punishable under Sections 147, 148, 294(b), 323, 324 and 307 I.P.C. and Section 3(1)(i) of the SC/ST (Prevention of Atrocities) Act, 1989, seek a direction to the learned Principal Sessions Judge, Krishnagiri to consider and dispose of their bail application that will be filed by them under Section 439 of Cr.P.C. on the same day of their surrender before him in connection with Cr.No. 51 of 2017 on the file of the respondent. 2. Heard the learned counsel for the petitioners.
3. Learned Additional Public Prosecutor, who took notice for the respondent, raised objection stating that one of the injured is still in the hospital.
4. However, considering the nature of the prayer sought for and taking note of the fact that the petitioners are prepared to surrender before the learned Principal Sessions Judge, Krishnagiri, there shall be a direction to the learned Principal Sessions Judge, Krishnagiri, to consider the bail application to be submitted by the petitioners along with their surrender before that Court, on the same day on merits and pass appropriate orders.
The criminal original petition is ordered accordingly.
