The Principal Sessions Judge, Dharmapuri, by order dated 04.01.2017, granted anticipatory bail to the petitioner on certain conditions. One of the condition imposed by the Court is that the petitioner has to deposit a sum of Rs.5,00,000/- to the satisfaction of the Judicial Magistrate No.II, Dharmapuri within 15 days from the date of the order. Now the petitioner has come up with the present Criminal Original Petition to set aside the condition pertaining to the deposit of Rs.5,00,000/-.
2. Mr.C.Emalias, learned Additional Public Prosecutor, takes notice for the respondent.
3. Considering the facts and circumstances of the case, the condition imposed by the Principal Sessions Judge, Dharmapuri in the order dated 04.01.2017 made in Crl.M.P.No.12 of 2017, with regard to the deposit of Rs.5,00,000/- alone is modified to the effect that the petitioner shall deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs Only) and shall execute sureties as directed by the learned Principal Sessions Judge, Dharmapuri, within a period of two weeks from the date of receipt of a copy of this order. Rest of the conditions imposed by the learned Principal Sessions Judge, Dharmapuri, shall remain unaltered.
4. The Criminal Original Petition is disposed of accordingly.
