JUDGMENT / ORDER

This Criminal Original Petition has been filed to call for the records pertaining to C.C.No.3417 of 2009 on the file of the learned VII Metropolitan Magistrate, George Town, Chennai, and quash the same.
2. The case relates to the year 2009. The main allegation is that the cheques issued by the second accused in the complaint were dishonoured for the reason “funds insufficient”. On the said allegation, statutory notice was issued to the petitioner / accused and since the said notice was not complied with, the complaint had been preferred.
3. Earlier this Court admitted the Criminal Original Petition in the year 2011. When this matter came up before this Court on 04.01.2017, there was no representation for the petitioner. Hence the matter has been posted today under the caption “for dismissal”. Even today there is no representation on behalf of the petitioner.
4. The learned Additional Public Prosecutor submitted that the matter has been settled before the Trial Court. In view of the statement made by the learned Additional Public Prosecutor, no further orders are necessary to be passed in this Criminal Original Petition and accordingly the Criminal Original Petition is closed.
