ORDER: (per the Hon’ble Sri Justice Sanjay Kumar)
This Writ Petition is filed in public interest alleging inaction on the petitioners’ representation dated 22.09.2008 in relation to the High Power Crushing Unit said to have been established by the eleventh respondent in Survey No.50 of Bommalaramaram Village and Mandal, Nalgonda District.
Sri G.Madhusudhan Reddy, learned Standing Counsel for the Telangana State Pollution Control Board, produced communication dated 15.10.2014 addressed by the Environmental Engineer, Regional Office at Nalgonda, Telangana State Pollution Control Board to the Joint Chief Environmental Engineer (Legal), Telangana State Pollution Control Board, Hyderabad, wherein he recorded that the Stone Crusher established by the eleventh respondent is presently not in operation and that the premises were locked. He further stated that a notice had been issued to the eleventh respondent to apply for Consent for Operation (CFO) in the event the unit was sought to be run as the earlier CFO was valid only up to 31.10.2010.
In the light of the above stated developments, the grievance of the petitioners with regard to the operation of the eleventh respondent’s crushing unit no longer survives for consideration.
The Writ Petition is accordingly closed. In the event the eleventh respondent seeks to resume operations, the Telangana State Pollution Control Board shall ensure that the same is done strictly in accordance with law.
Pending miscellaneous petitions, if any, shall stand closed in the light of the above order. No costs.
