ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Irrigation and CAD appearing for the first respondent and the learned standing counsel for ACB appearing for the respondents 2 to 4.
This writ petition is filed for a mandamus, declaring the action of the respondents in not considering the representations dated 18-3-2011 and 14-11-2013 made by the petitioner for reviewing the orders passed in G.O.Ms.No.233/I&CAD (IW Services-VI) department dated 18-08-2009 as arbitrary, illegal and consequently direct the respondents to consider the representations made by the petitioner.
It is submitted by the petitioner that a case was registered by the Anti Corruption Bureau (for short “ACB”) against the petitioner in Crime No.01/RC/ACB.VZM/2008 dated 14-2-2008 of ACB Vizianagarm District alleging that the petitioner possessed disproportionate assets to a tune of Rs.20,08,300/- (Rupees twenty lakhs, eight thousand, three hundred only). Thereafter, the petitioner submitted his explanation stating that his agricultural income and the income of his wife have not been taken into consideration while calculating the assets. He filed Criminal Petition No.1971 of 2010 seeking a direction to ACB to take into consideration his agricultural income and income of his wife while calculating the assets. This Court disposed of the said petition on 26-03-2010, directing the first respondent therein to carefully examine the agricultural income of the petitioner and income of his wife and file appropriate revised charge sheet. Thereafter, the ACB filed the revised charge sheet by reducing the value of disproportionate assets from 16,65,327 to Rs.16,06,463/-. Subsequently, he made a representation to the Principal Secretary to Government, I & CAD Department to properly calculate the assets. He filed W.P.No.19143 of 2010 seeking a direction to the first respondent therein to consider his representation dated 22-3-2010 and the learned Single Judge of this Court passed an order directing the petitioner to make a representation to review the order passed in G.O.Ms.No.233, dated 18-8-2009 and directed the respondents to take appropriate decision in the matter.
The grievance of the petitioner is that in spite of the direction given by this Court to consider his representations, the issue is kept pending and no action so far has been taken on his representations.
In the aforesaid circumstances, the respondents are directed to dispose of the representations submitted by the petitioner dated 18-3-2011 and 14-11-2013 pending if any, within a period of six weeks from the date of receipt of this order and pass appropriate orders thereon.
The writ petition is disposed of at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
