The Court delivered the following : [order follows] THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.19382 of 2014 ORDER :
The grievance of petitioners is that 4th respondent suffered a disqualification by having four children and was not competent to contest to the election to the Bachupally Gra m Panchayat as a Ward Member; and in spite of incurring such disqualification, the 4th respondent was allowed to contest the said election; and he was elected as a Ward Member and subsequently as an Upa Sarpanch.
2. The petitioners herein claim to have submitted a representation to respondent nos.2 and 3 about the disqualification of the 4th respondent.
3. The counsel for 3rd respondent however denies that any such representation was made to him about the alleged disqualification of 4th respondent.
4. Therefore, the petitioners shall be at liberty to submit a fresh representation to 3rd respondent as to the alleged disqualification of 4th respondent within two (2) weeks from today; within four (4) weeks of receipt of such representation, the 3rd respondent shall follow the procedure prescribed in Section 22 of the Andhra Pradesh Panchayat Raj Act, 1994 and take action in accordance with law after giving notice to 4th respondent.
5. The writ petition is disposed of with the above directions. No order as to costs.
6. Miscellaneous petitions, pending if any, in this writ petition shall stand closed.
