Heard Shri S.P. Mishra, Advocate, holding brief of Shri Ved Ratan, learned counsel for the applicant as well as learned A.G.A. and perused the record.
This application u/s 482 Cr.P.C. has been preferred seeking the quashing of impugned order dated 11.10.2019 passed by learned Special Judge (SC/ST) Act, Aligarh in Final Report No.423 of 2019 (Smt. Geeta Devi vs. Krishnapal Singh and others), P.S.-Khair, District-Aligarh whereby protest petition moved on behalf of the applicant has been rejected, the final report has been accepted and the proceedings u/s 182 Cr.P.C. were initiated against the applicants.
I have perused the impugned order in the light of the submissions made at the Bar.
There is delay in lodging of the F.I.R. and besides this, the applicant has not submitted any medical report in support of version made in the F.I.R. Learned Magistrate, after going through the entire facts and circumstances of the case and after discussing the legal aspects of the matter, has passed the order impugned and initiated proceedings against the applicant u/s 182 Cr.P.C. The impugned order reflects judicial application of mind. I do not find any illegality, perversity and any abuse of court's process in the impugned order.
The unscrupulous litigants should be dealt with strictly and should be crushed with iron hand. Irresponsible litigants are creating havoc in the society and they are habitual of initiating false and frivolous cases against the opponents just to level the scores.
Under these circumstances, this application u/s 482 Cr.P.C. stands dismissed.
Office is directed to send the copy of this order to the court below within 15 days after having photo copy of the same.
