Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 5.
The petitioner contends that she is running a Chura Machine on her own land which is far away from the Abadi area it does not even create any kind of pollution. But the respondents on the complaint of the respondent no.5 are not permitting the petitioner to run the same which is adversely affecting the right of livelihood of the petitioner.
In connection with the above, there appears to be some dispute between the private parties in respect whereof a report has been submitted by the Tehsildar on 17.12.2018 stating that the Chura Machine of the petitioner has been stopped.
The petitioner is stated to have raised his grievance before the District Magistrate vide representation dated 07.01.2019 sent by the registered post but no action has been taken on it.
In view of the aforesaid facts and circumstances, as the matter involves consideration of factual aspects, we dispose of the writ petition with a direction to the respondent no.2- District Magistrate, Mirzapur to consider the grievance of the petitioner at his own level pursuant to the representation dated 07.01.2019 or any fresh representation which the petitioner may file along with a certified copy of this order before him within a fortnight and decide the same in accordance with law most expeditiously, preferably within six weeks of the submission of the fresh representation.
