THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.19404 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner. There is no representation for the respondent.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the respondent in not considering the representation of the petitioner dated 23-6-2014 to promote the petitioner from the post of Assistant Executive Engineer to the post of Deputy Executive Engineer as illegal, arbitrary and unconstitutional, consequently declare that the petitioner is eligible and entitled to be promoted as Deputy Executive Engineer in the respondent’s corporation.
The petitioner is working as in-charge Deputy Executive Engineer at Hyderabad Metro Rail Limited. On receipt of the Memo dated 1-11-2013, he attended the interview for promotion to the cadre of Deputy Executive Engineer before the Departmental Promotion Committee. According to the petitioner, the Board has approved the panel list of the candidates for the panel year 2013-14, which contains his name.
It is submitted by the petitioner that he came to know that one Y.Venkateswara Rao has been promoted as a Deputy Executive Engineer. He claims that he is eligible for promotion as Deputy Executive Engineer from the post of Assistant Executive Engineers seniority. He made a representation dated 23-6-2014 to promote him to the post of Deputy Executive Engineer in the respondent corporation, but the same is said to be pending with the respondent. His grievance is that the respondent is not considering his representation and not promoting him to the post of Deputy Executive Engineer.
In the circumstances stated by the learned counsel appearing for the petitioner, the respondent is directed to consider and dispose of the representation made by the petitioner seeking promotion to the post of Deputy Executive Engineer in accordance with rules, within a period of six weeks from the date of receipt of copy of this order.
With the aforesaid direction, the writ petition is disposed of. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
