This writ petition was filed challenging the constitutional validity of Section 242D of the Andhra Pradesh Panchayat Raj Act, 1994 and Article 243M(4)(b) of the Constitution of India in the context of the elections held in 2006. The challenge would not survive at this stage in the context of the 2006 elections. Sri K.S. Murthy, learned counsel for the petitioner, therefore seeks liberty to enable his client to challenge the validity of the aforestated provisions if the need arises in future.
Recording the said submission, the writ petition is dismissed as infructuous subject to the liberty aforestated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
