JUDGMENT / ORDER

The Hon’ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.38136 of 2014
Dated 11.12.2014
Between: G.Chaitanya …Petitioner And The State of Telangana rep. by its Prl.Secretary, Education Dept., Hyderabad and 2 others.
…Respondents Counsel for the petitioner: Mr.Pravin Kumar Counsel for respondent No.1: AGP for Higher Education The Court made the following:
Order:
This Writ Petition is filed for the following substantive relief:
“to issue the Hall Ticket to the petitioner for the exams of III Semester MBA scheduled to be held from 12th December to 2nd January, 2014, for the academic year 2014-2015 and at the same time, permit the petitioner to sit in the IV Semester Classes of MBA.
At the hearing, it is not disputed by learned Counsel for both the parties that the issue raised in this Writ Petition is covered by a Division Bench Judgment of this Court in B.Yugandhar V. Principal,
[1]
Kuppam Engineering College , wherein it was held that by a judicial fiat, this Court cannot direct the University to condone the shortage of attendance of the students contrary to its Regulations.
In the light of the ratio laid down in the above- mentioned case, which is being consistently followed by this Court, even if the petitioner has a bona fide reason for not attending the classes, no Mandamus can be issued to the respondents to permit the petitioner to appear in the examinations contrary to the regulations of respondent No.2- University.
For the above-mentioned reasons, the Writ Petition fails and the same is, accordingly, dismissed.
As a sequel to dismissal of the Writ Petition, WPMP.No.47708 of 2014, filed by the petitioner for interim relief, is dismissed as infructuous.
