JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) MONDAY, THE ELEVENTH DAY OF AUGUST TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 21108 of 2014 BETWEEN G.Babu Reddy AND ... PETITIONER The Government of Andhra Pradesh, rep. by its Secretary and two others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner states that he is an ex-sarpanch and also member of the Mandal Praja Parishad School functioning in Basavankonda Village, Madanapaly Mandal, Chittoor District. He also claims that the children of his relatives are studying in the school and claims that the school was established in the year 2004 in an area of Ac.1-50 cents. Since there were some encroachments on the land of the school, teachers as well as the local people who resisted the encroachments have brought it to the notice of the authorities by making representation, dated 18.01.2014, through the headmaster requiring the revenue authorities to conduct a survey for constructing the compound wall around the school premises. It is stated that such compound wall is necessary in order to protect the land of the school from encroachments. Alleging inaction on the said representation, the present writ petition is filed.
3. Learned Government Pleader, who has secured instructions from the Tahsildar, Madanapally, states that survey No.1098 in an extent of Ac.4-80 cents was originally classified as Government A.W.D. and subsequently the land was sub divided into sub numbers 1 to 4; that to the extent of Ac.0-90 cents in S.No.1098/2, an extent of Ac.0-55 cents was issued for house site pattas to 24 beneficiaries @ Ac.0-02½ cents each and 30 links road was also formed; and that remaining extent of Ac.0-35 cents was covered with the existing school building and the boundaries and physical features of the existing school buildings were shown to the Head Master of the Mandal Parishad School through proper acknowledgment dated 25.07.2014.
4. It is apparent from the instructions, referred to above, that a survey was already conducted and the survey number was already sub divided and that different extent under which the said survey was conducted was classified and divided as per the revenue record. It is also born out from the instructions, as aforesaid, that since the Head Master of the aforesaid Mandal Parishad School had already acknowledged the physical features and boundaries, as stated above, no further directions are called for in this writ petition. However, it is open for the petitioner and the school authorities to take appropriate proceedings, if there is any short fall in the extent.
Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
