JUDGMENT / ORDER

ORDER:
Heard.
2. Petitioners complain of harassment by respondent No.4, whereby they are pressuring them to settle the dispute with respondent No.5.
3. Learned Government Pleader, on instructions, states that respondent No.4 has received the complaint from respondent No.5 about missing of her husband from 03.11.2014 and is not traceable. Based on the complaint, a case in Crime No.123 of 2014 was registered and investigation was taken up by examining four witnesses. It is further stated that during the course of investigation, they have made enquires from the petitioners over phone to find out availability of missing person with them. However, they have replied in negative and except that no further action was taken against the petitioners; no police personnel were deputed; nor the petitioners or their relatives were called at any point of time. The allegations of the petitioners are, therefore, denied. It is stated that except investigating the aforesaid complaint and making enquiries in connection therewith, the investigating officer has not taken any further action against the petitioners.
4. In view of the above, therefore, since the enquiries were made by the police with the petitioners only as a part of investigation, the allegation of the petitioners remains unsubstantiated. However, if respondent No.4 requires the presence of the petitioners for any other purpose connected with the said crime, respondent No.4 shall follow the provisions of Section 41-A Cr.P.C. and take appropriate further steps in accordance with law.
Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
