Order:
This Writ Petition is filed with the grievance that respondent Nos.2 and 3 have not been allotting essential commodities to fair price shop No.28 of Konuru Village, Atchampet Mandal, Guntur District, in respect of which the petitioner holds authorization, though her application filed for renewal of the same four days before its expiry, is pending with respondent No.2.
In my opinion, the petitioner ought to have first approached respondent No.2 with a representation seeking redressal of her grievance. I have no reason to believe that if the petitioner’s application for renewal of her fair price shop authorization stated to have been made before its expiry is pending with respondent No.2, respondent Nos.2 and 3 would have withheld the supply of essential commodities to her fair price shop. Had the petitioner made a written representation to respondent Nos.2 and 3, the real reason for non-supply of essential commodities to her fair price shop would have come to the fore. Hence, the petitioner is permitted to make a written representation to respondent No.2. Within one week of making such representation, respondent No.2 shall cause an enquiry and send written communication to the petitioner as to the reasons for withholding the supply of essential commodities to her fair price shop for the month of September, 2014. If the petitioner feels aggrieved by such communication, she shall be free to avail appropriate remedy in accordance with law.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel, WPMP.No.40509 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
