Respondents Petition filed under Article 226 of the Constitution of India, praying to issue a WRIT OF HABEAS CORPUS, to calling for the records in detention order Memo No.387/BCDFGISSSV/2017 dated 29.06.2017 on the file of the 2nd respondent and quash the same and direct the respondents herein to produce the body of the petitioner husband Ganesan @ Jangli Ganesan, aged about 32 years, now confined in Central Prison, Puzhal before this Court and set him at liberty.
For Petitioner : Mr.J.Samiullah For Respondents : Mr.V.M.R.Rajentran, Additional Public Prosecutor O R D E R [Order of the Court was made by A.SELVAM, J.] This Habeas Corpus Petition has been filed under Article 226 of the Constitution of India praying to call for the records relating to the detention order passed in Memo No.387/BCDFGISSSV/2017 dated 29.06.2017 by the Detaining Authority against the detenu by name, Ganesan @ Jangili Ganesan, aged 32 years, S/o.Lakshmipathy, residing at No.69, Sidco Nagar, 9th Street, Balaramapuram, Villivakkam, Chennai – 39 and quash the same.
2. Learned Additional Public Prosecutor has represented that the Detention Order in question has already been revoked, by virtue of G.O.Rt.No.4067 dated 23.08.2017 and a copy of the same is submitted, wherein, it is clearly stated that the Detention Order in question has already been revoked.
3. Considering the above said factual circumstances, the relief sought in the petition has become infructuous.
4. In fine, this petition is dismissed.
