ORDER:
This Writ Petition is filed for a mandamus to set-aside proceedings in Ref.B/5177/2014, dated 22-8-2014 of respondent No.3 whereby he has suspended the petitioner’s fair price shop authorisation.
As the allegations on which the petitioner’s authorisation has been suspended were prima facie found untenable, this Court has directed respondent No.3 to be personally present. Accordingly, he is present in the Court today. He has conceded that the variations in rice, sugar and red gram dal allegedly found during the inspection are well within the permissible variations under Clause 24 of the A.P. State Public Distribution System (Control) Order 2008. He has also conceded that charge Nos.3 and 4 are not supported by even prima facie evidence while charge No.2 is wholly insignificant. Respondent No.3 has also stated that he has been transferred from the post of the Revenue Divisional officer, Jammalamadugu and that he will be careful in future.
In the light of the above discussion, the impugned order is set-aside and the Writ Petition is disposed of with the direction to respondent No.3 not to proceed against the petitioner on the basis of the charges mentioned in the impugned proceedings.
As a sequel to the disposal of the Writ Petition, WPMP No.38665 of 2014 is disposed of as infructuous.
