High Court Of Gujarat|14 May, 2012

JUDGMENT / ORDER

1.0 The convict has filed present application through jail seeking Parole Leave for a period of 45 days so as to carry out repairs of his house, which is likely to be damaged in ensuing monsoon season.
2.0 Learned Additional Public Prosecutor Mr. Patel made available for perusal the Jail Remarks. The convict is undergoing life imprisonment in Sessions Case No. 135 of 1997 for an offence punishable under Section 302 of the IPC. He was granted 21 days' leave for the same purpose i.e. for repairing of house. He absconded and was arrested and brought to the jail after 2018 days on 22nd January 2011. Earlier, in the year 2002, he has enjoyed Temporary Bail for a period of 30 days for the same purpose i.e. repairing of house. Again in 2004, he was released on Temporary Bail for 21 days for the same purpose. The fact that the convict had absconded for 2018 days, this application is rejected.
