This present criminal revision has been filed against the judgment and order dated 9.7.2021 passed by Addl. District and Sessions Judge/ Special Judge (POCSO Act), Allahabad in Criminal Appeal No. 106 of 2019 (Fulel Singh Vs. State of U.P. and another) arising out of the judgment and order dated 16.8.2019 passed by Principal Magistrate Juvenile Justice Board, Prayagraj in case No. 127 of 2019, arising out of case crime no. 332 of 2017, under sections 302/201.
From the perusal of the record it appears that there are two certificates of date of birth, but Hon'ble Supreme Court says that if there are two different date of birth certificates then only High School certificate is permissible.
The ruling cited by the revisionist is not applicable in the present case.
The present revision has no merit and is hereby dismissed.
