JUDGMENT / ORDER

1.0 Present application is filed by the under trial prisoner through his mother seeking Temporary Bail for a period of 30 days so as to attend to his father who is advised operation for urinary track disease. The under trial prisoner is in jail in connection with C.R. No. I-683/2010 dated 14th October 2010 for the offences punishable under Sections 143, 147, 148, 307, 365, and 506(2) of the Indian Penal Code and Section 135(1) of the Bombay Police Act at the Satellite Police Station, Ahmedabad. He was arrested on 17th October 2010. In support of the application medical papers are produced. The applicant - mother of the prisoner states that he was earlier released for two days.
2.0 Rule.
Learned Additional Public Prosecutor Mr. Patel waives service of process of Rule.
3.0 Taking into consideration the contents of the application, the application is allowed. The under trial prisoner is ordered to be released on Temporary Bail for a period of 30 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) with one surety of the like amount to the satisfaction of the jail authorities.
3.1 In addition to above, he shall mark his presence at the nearest Police Station on every alternate day between 9:00 a.m. and 2:00 p.m. 3.2 That he shall not leave the limits of Ahmedabad City.
3.3 That he shall surrender to the jail authorities on expiry of the Temporary Bail period.
3.4 Rule is made absolute to the aforesaid extent.
