Heard Sri Ajay Kumar Sharma, learned counsel for the petitioners and Sri Shri Kant, learned counsel appearing for the respondent nos. 2, 3 and 4-U.P. Avas Evam Vikas Parishad.
The petitioners by means of this writ petition want that they should be given possession of 50% of the developed land in terms of the order dated 8.5.2014 of the U.P. Avas Evam Vikas Parishad, which has been filed as Annexure-4 to the writ petition and that details of the development charges be provided to them so that the same may be deposited.
A perusal of the order dated 8.5.2014 which is on record, reveals that about 3.72 acres of the land of the petitioners was adjusted within the acquisition made for the purpose of development of U.P. Avas Evam Vikas Parishad and Avas Evam Vikas Parishad had agreed to allot 50% of it about 1.60 acres.
The aforesaid grievance of the petitioners can be taken care of at the level of Housing Commissioner, U.P. Avas Evam Vikas Parishad.
In view of the above, we dispose of the writ petition with the direction to the respondent no. 3 to consider the above grievance of the petitioners in accordance with law in the light of the office order dated 8.5.2014 most expeditiously, if possible, within six weeks and if the petitioners are held entitled for any land, the possession of the same shall be delivered within next two months thereof subject to deposit of the development charges.
